Future Form Rejects Media Speculation and awaits Kimber SC Final Report

Leading Australian formwork specialist, Future Form Civil (‘Company’), today wishes to clarify media reports of allegations of wrong-doing on the Western Sydney International Airport Metro Station site.

Future Form is surprised by today’s premature release of the Kimber Report.

As far as Future Form is aware, Sydney Metro or We Build have yet to receive the final Kimber Report and is therefore unable to respond to specific allegations. The media speculation and indeed all commentaries on the Kimber investigation are premature.

Future Form also wishes to clarify that the Kimber SC investigation has been a process whereby different matters are presented, and Future Form addresses them. The process is still underway, however:

  • Future Form’s understanding is that no specific existing entitlements violations have been identified and there is no demonstration that Future Form had any knowledge of entitlements violations or payment anomalies.
  • Future Form has not been involved in any inappropriate influence over the Industrial Relations Audit.
  • Process management of subcontractors can be improved.
  • Any assertion of a finding of underpayment of workers, inadequate insurance cover and tax fraud are not findings able to be made by Max Kimber and are matters requiring review by each relevant regulator.

 

Future Form believes that there are matters which are still under review. An example follows. 

 

Reports on invoices: Mr. Kimber SC has sought clarification on invoices submitted. Future Form have provided evidence of all worker time and attendance to the investigation. Future Form was of the understanding that this satisfied the inquiry and would be asked if any further detail was required.

Future Form also wishes to clarify that it has no association to the allegation of the isolated cash payment and it has cooperated to the maximum extent required with the authorities to confirm this. The subcontractor associated to this allegation was terminated as soon as it was brought to the attention of Future Form.

Future Form has improved its processes to ensure such events do not occur in future.

“The Company’s number one priority is to ensure robust WHS systems on our sites across Australia and that each and every one of our staff and contractors are safe, are treated fairly and equally and that there is full-compliance and proper procedure regarding payments across the workforce.”

The spokesperson said Future Form would continue to work with regulators and agencies as part of any NSW Government inquiry.
