TANNING BED OPERATOR ORDERED TO PAY $35,300 FOR RADIATION OFFENCES

A Sydney cosmetic business has been court-ordered to forfeit all nine of its tanning beds and pay $16,000 in fines and $19,300 in legal fees for illegally operating cosmetic tanning services using ultra-violet radiation.
The NSW Environment Protection Authority (EPA) prosecuted F.A. Beauty Pty Ltd in the Local Court of NSW for two offences under the state’s radiation laws.
Trading as The Tanned Me, F.A. Beauty operated two premises in Bondi and Fairfield, where EPA investigators found nine UV tanning beds and evidence of cash-in-hand payments.
NSW EPA Executive Director of Regulatory Practice and Services Emma Whale said it is illegal to provide, or offer to provide, commercial UV cosmetic tanning services in NSW.
“This case is the culmination of a long and detailed investigation and the first time we have successfully prosecuted a business for offering UV tanning services,” Ms Whale said.
“Officers inspected The Tanned Me’s Fairfield salon in November 2023 and subsequently conducted a joint inspection of the Bondi salon in August 2024 with NSW Police in attendance.
“We found more than $800 in cash across both premises and evidence of bookings made by clients through online messaging platforms.
“Our radiation laws are in place for a good reason, which is to protect people’s health. Exposure to UV radiation can significantly increase your risk of skin cancer.
“In fact, people who use a UV tanning bed before 35 years of age have a 75% higher chance of developing melanoma.”
In August 2025, the NSW Government strengthened the state’s radiation laws, increasing on-the-spot fines for commercially operating a tanning bed from $1,500 to $10,000 for a corporation and up to $5,000 for an individual.
The laws also ban advertising or promoting UV tanning services on social media, which was identified as a common tactic used by illegal solaria operators.
These strengthened provisions reflect the serious health risks posed by commercial solarium use.
