WARRINGAH FREEWAY UPGRADE CONTRACTORS FINED FOR LICENCE BREACH

CPB Contractors Pty Limited (CPB) has been fined $45,000 by the NSW Environment Protection Authority (EPA) for breaching its licence conditions by failing to properly implement noise controls during nighttime construction work on a section of the Warringah Freeway Upgrade in January.

It is the second time CPB has been fined for noise-related issues connected to the construction of the Warringah Freeway Upgrade, a major NSW Government transport project incorporating road works from the north of Sydney to Willoughby Road, Naremburn, in North Sydney.

NSW EPA Director of Operations David Gathercole said the fine followed an unannounced, out-of-hours noise compliance inspection in mid-January.

“This is a major state transport project, and we recognise that some work needs to be carried out at night and during holiday periods to minimise disruption and keep Sydney moving,” Mr Gathercole said.

“However, when EPA officers arrived to inspect a section of the upgrade at Cammeray at about 11pm, they observed construction work in progress and found noise from the activity was audible from a nearby residential street.

“Our inspection found CPB had not implemented all reasonable and feasible noise mitigation measures, as required under the project’s Environment Protection Licence, including in the area where noisy work was underway.”

CPB is the principal contractor delivering the Warringah Freeway Upgrade, which commenced in 2022.

The EPA continues to carry out unannounced noise compliance inspections along sections of the project to confirm all approved nightworks meet the noise-mitigation standards set out in its Environment Protection Licence.
